Article 25 of the EUDR regulation mandates that Member States set maximum fines of at least 4% of the operator's total annual EU-wide turnover. Fines must be proportionate to environmental damage and may be increased to exceed any economic benefit from non-compliance. Additional sanctions include confiscation of products and revenues, and temporary exclusion from public procurement for up to 12 months.

Regulatory essentials

What the EUDR requires — in plain language

The key requirements of Regulation (EU) 2023/1115 that every natural rubber operator needs to know.

3 mandatory conditions (Art. 4)

① Deforestation-free: produced on land with no deforestation after December 31, 2020. ② Legally produced: compliant with all laws of the country of production. ③ Due Diligence Statement (DDS): submitted via the EU TRACES NT system before market placement.

Geolocation requirements (Art. 9)

Plots > 4 hectares: polygon coordinates delineating the perimeter. Plots ≤ 4 hectares: single point (latitude/longitude). Minimum 6 decimal digits (~11 cm precision). Format: GeoJSON · Coordinate system: WGS84 (EPSG:4326).

Due Diligence Statement (DDS)

A formal declaration submitted via the EU TRACES NT system, confirming due diligence was conducted and the risk of non-compliance is negligible. Records must be retained for 5 years.

Enforcement deadlines

Large & medium enterprises: December 30, 2026. Micro & small enterprises: June 30, 2027. Confirmed final — no further postponement (EU Simplification Package, May 2026).

Country risk classification (Art. 29)

Standard risk (~50 countries, incl. Brazil, Côte d'Ivoire, Indonesia): Full 3-step due diligence required. Low risk (~140 countries): Simplified due diligence. High risk (4 countries): Enhanced scrutiny.

Product scope

Natural rubber (Hevea brasiliensis) and derived products: tires, gloves, conveyor belts, hoses, and more (CN codes 4001–4017). Synthetic rubber: NOT covered. Mixed products: covered if they contain natural rubber.

Frequently asked questions

EUDR & Natural Rubber — Common Questions

What is the EUDR cut-off date?

December 31, 2020. Rubber must be produced on land that has not been subject to deforestation after this date (Art. 2(13)).

Does my RSPO or FSC certification exempt me from the EUDR?

No. Certifications can support your risk assessment but do not replace the mandatory requirements: plot-level geolocation, deforestation-free verification, and a Due Diligence Statement (DDS) submitted via TRACES NT.

Is synthetic rubber covered?

No. Synthetic rubber (petrochemical origin) is excluded. However, mixed products containing natural rubber (e.g., tires) are in scope.

What geolocation data do I need?

For plots > 4 hectares: polygon coordinates defining the perimeter. For plots ≤ 4 hectares: a single GPS point. All coordinates must have at least 6 decimal digits and be in GeoJSON format (WGS84).

What happens if I don't comply?

Are small cooperatives exempt?

No, but micro and small enterprises have an extended deadline until June 30, 2027, and benefit from simplified due diligence requirements for low-risk countries.
